ANTONIO Sablan has filed a complaint in Superior Court against Kingfisher Corporation, doing business as Kingfisher Golf Links, saying he sustained injuries after the golf cart he was driving flipped.
Sablan, represented by Torres Brothers LLC, is suing the Talafofo golf course for negligence.
Sablan wants the court to award him no less than $300,000 in “non-economic damages for “pain and suffering, emotional distress, and diminished quality of life….”
He also wants the court to issue a judgment against the defendant for past, present and future economic and non-economic damages in an amount to be proven at trial.
He is likewise seeking legal fees and other relief.
According to the lawsuit, on or about June 9, 2021, Sablan played golf at Kingfisher as a customer.
On that day, “defendant provided plaintiff with a golf cart to use to play on its course. Plaintiff drove defendant’s golf cart from hole number 5’s tee box and on his way to the fairway, the downhill part, the golf cart flipped and as a result, plaintiff sustained injuries,” the complaint stated.
“Defendant owns the golf cart that plaintiff was driving at the time of the incident. Defendant does its own repairs and maintenance of the golf cart that plaintiff was driving at the time of the incident. Defendant’s premises where plaintiff fell on June 9, 2021, is particularly situated in Talafofo, Saipan. The premises where plaintiff fell was owned, controlled, maintained and/or operated by defendant. The golf cart that flipped while plaintiff was driving was owned, controlled and maintained by defendant.”
The complaint was filed on March 28, 2023.
