IPI in substantial compliance, says lawyer

ATTORNEY William Fitzgerald told the federal court that Imperial Pacific International (CNMI) LLC has paid a portion of the settlement amount and is now in substantial compliance with the judgment in the civil lawsuit filed by a former IPI employee.

Fitzgerald updated the court when asked by Chief Judge Ramona V. Manglona of the District Court for the NMI about the status of the case.

At the hearing on Thursday, IPI, represented by attorney Stephen Nutting, told the court “that funds should be available next week.”

On Oct. 7, 2021, Judge Manglona entered a finding of contempt against IPI for failing to comply with the judgment in the case after Fitzgerald told the judge that a settlement check in the amount of $30,000 paid by IPI had bounced.

Represented by Fitzgerald, the plaintiff is Yuqin Gui, a former IPI employee, who has settled her complaint against IPI for $60,000.

Gui earlier accused Stephen Brown, IPI pit manager, of sexual harassment and intentional infliction of emotional distress.

On March 23, 2021 Gui and IPI with their respected attorneys stipulated for an entry of judgment and dismissal of the lawsuit. The stipulation also dismissed with prejudice the complaint against Brown.
