IPI satisfies judgment, says law firm

THE law firm of Banes Horey Berman & Miller has filed in federal court an acknowledgement of satisfaction of judgment after the check tendered by Imperial Pacific International LLC cleared the bank.

The law firm, through attorney Richard Miller, “acknowledges full and complete satisfaction of the judgment in this matter, including all attorney fees and costs, and suggests that entry of satisfaction of the judgment be entered on the docket and the case closed.”

The law firm’s complaint stated that IPI owed more than $120,000 in attorney’s fees and expenses on all matters for which the law firm performed legal services for the Saipan casino investor.

On Feb. 10, 2021, the District Court for the NMI entered judgment against IPI in the amount of $114,311.38, including prejudgment interest at the rate of 9%, plus post-judgment interest at the rate of 0.07% per annum, along with costs.

On March 26, 2021, the court ordered IPI to pay the plaintiff reasonable attorney’s fees and costs of bringing an enforcement action.

On Sept. 24, 2021, the court issued an order to show cause why IPI should not be held in contempt for failure to make payment.

On Oct. 7, 2021 the court found IPI was in contempt and granted the plaintiff attorney’s fees and costs.

The law firm and IPI eventually agreed to compromise on the remaining amounts due on the judgment, including attorney’s fees and costs, for the sum of $67,000.

On Oct. 20, 2021, IPI tendered to the law firm a personal check in the amount of $67,000.

The check has cleared the bank, Miller said.

He and IPI attorney Stephen Nutting, through a stipulation, have asked the federal court to discharge the order to show cause.
