Kasiano filed his complaint on November 25 through attorney J. Uduch Sengebau Senior.
Kasiano was among the candidates of the 14th Angaur State General Election on November 4.Maria Gates, Warren Fukuichi, Faustino Busi Robert, Flavin Misech and Leon Gulibert were the five candidates who received the most votes to become members of the Olbiil Era Ngeaur.Kasiano is seeking for the reversal of the PEC’s November 21 decision and for a declaration from the court that Maria Gates, Warren Fukuichi, Fustino Busi Robert and Flavin Misech are not residents of Angaur State within the meaning of Article VIII, Section 3 of the Angaur State Constitution.Kasiano is seeking for the reversal of the certification of election results of the 14th Angaur State General Election and for an order declaring him as one of the members of the Angaur State Legislature.Kasiano also wanted the PEC to conduct a new election for the Angaur State Legislature.Kasiano’s complaint states that Gates, Fukuichi, Robert and Misech do not meet the residency requirements under Article VIII, Section 3 of the Angaur State Constitution.The complaint states that Gates was born and raised in Koror and has been a resident of Koror . She owns a house in Ngerchemai Hamlet, Koror.The complaint states that Gates does not have a house in Angaur and she does not physically reside in Angaur.The complaint states that Fukuichi, Robert and Misech are also residents of Koror.The complaint states that Kasiano filed a protest regarding the qualifications of Gates, Fukuichi, Robert and Misech.The complaint states that PEC’s lawyer advised the Election Commission that Kasiano’s protest was without merit.The complaint states that PEC violated his constitutional rights to equal protection and due process of laws as guaranteed under Article IV of the Constitution of the Republic of Palau and that the Election Commission did not conduct an investigation as to the qualifications of Gates, Fukuichi, Robert and Misech to run as candidates for Angaur State Legislature.
