2 of 8 Chinese nationals sentenced to time served

THE District Court for NMI on Wednesday sentenced to time served — 10 days — Bin Weng and Yuxing Lin, two of the eight Chinese nationals who were caught attempting to illegally enter Guam last month.

Weng and Lin, with their respective counsels, Matthew Gregory and Daniel Guidotti, appeared before Senior Judge Alex R. Munson in separate sentencing proceedings.

Assistant U.S. Attorney Ashley Kost, who represented the U.S. government, told the court that a total of $4,859 was forfeited, but the “overage amount” of $859 will be returned to Weng.

Pursuant to the Sentencing Act of 1984, and provisions found in 18 U.S.C. Section 3553(a), “it is the judgment of the court that defendant Bin Weng is hereby sentenced to time served (10 days) …followed by a term of one year of supervised release.”

The defendant was also ordered to pay a special assessment fee of $100.

The court told Weng that once he is prepared to depart the CNMI, he is to contact the U.S. Probation Office or the Immigration Customs Enforcement Office to deliver the passport to the airport.

As for Lin, Kost told the court that forfeiture was not applicable to the defendant.

Lin was also sentenced to time served (10 days) followed by one year of supervised release. Lin shall also pay a special assessment fee of $100 immediately.

Lin was also told that once he is prepared to depart the CNMI, he is to contact the U.S. Probation Office or the Immigration Customs Enforcement Office to deliver the passport to the airport.

Weng and Lin were among the eight Chinese nationals arrested last month for attempting to enter Guam illegally by paying an undercover agent posing as boat captain. The other Chinese nationals are Xiping Gao, Lu Xu, Qin Chen, Ziyou Xu, Xiangke Zhang and Fuquan Miao.

Each of them was charged with “engaging in a conspiracy [to transport, move, or attempt to transport or move] an alien within the United States, knowing or in reckless disregard of the fact that the alien came to, entered, and remained in the United States in violation of law.”
