TWO alien workers have filed a lawsuit in federal court against Tinian Dynasty Hotel & Casino for allegedly refusing to pay their overtime wages.
Lal Limbu and Sandeep Rai sued Hong Kong Entertainment (Overseas) Investment Ltd., the owner of the hotel, for alleged breach of contract and violation of the Fair Labor Standards Act and Minimum Wage and Hour Act.
The plaintiffs, through attorney Danilo T. Aguilar, asked the U.S. District Court to order Hong Kong Entertainment to pay them their overtime wages, liquidate and punitive damages.
Anthony Long, counsel for Hong Kong Entertainment, was unavailable for comment yesterday.
Limbu alleged that Tinian Dynasty owed him $7,353 in unpaid overtime compensation while Rai claimed that his former employer owed him $11,945 in overtime wages.
Aguilar alleged in the complaint that in 1997, Limbu was recruited from Nepal to work as a security supervisor at Tinian Dynasty where he worked from April 1998 to March 2002.

The lawyer alleged that his clients were improperly classified by Tinian Dynasty as executives and as a result, the hotel failed to compensate them for hours worked in excess of 40 hours per week at a rate of not less than one and one-half of regular pay.
Limbu said he worked 784 hours of overtime between Feb. 1999 to March 2001 for which he had not been compensated.
Rai claimed he worked 1,104 hours of overtime between Feb. 1999 to Dec. 2001 for which he had not been paid.
