Administration ordered to submit documents, correct non-existent account number

The court set the continuance hearing for June 4.

In his four-page order, Associate Judge David A. Wiseman ordered the defendants to provide the billing invoice, voucher/payment and supplier payment inquiry in a sealed envelop for an “in camera” review on or before May 28.

These documents pertain to the payments made by the governor to the law firm representing him in his federalization lawsuit.

Wiseman also ordered the defendants to file a correction and/or clarification regarding the governor’s account number that was improperly identified on or before May 28.

Wiseman informed Assistant Attorney General Braddock J. Huesman, or another counsel who is ready to appear and argue the government’s position, that the governor’s account number previously provided to Sablan was “erroneously identified” because the account number does not exist.

On May 13, the defense requested a continuance in the matter until the second week of June.

In his request, Huesman cited business and medical reasons.

The court granted a partial continuance after finding good cause during the hearing on May 14, where Assistant Attorney General Meaghan Hassel-Shearer appeared on behalf of the defendants.

Sablan appeared without a lawyer.

Wiseman said as noted during the hearing, the Open Government Act provides for an expedited litigation schedule.

He said the court has exercised diligence in efforts to comply with the expedited scheduling required by the law.

But while an additional short continuance will be granted, Wiseman said the government counsel’s request to postpone this matter until mid-June cannot be accommodated.

Sablan sued Fitial and Inos to compel the disclosure of the public funds they were spending on the federalization lawsuit.
