AGO asks court to release rape defendant

Superior Court Associate Judge Kenneth L. Govendo granted the motion of the AGO to release Benson John D. Dela Cruz from the custody of the Department of Corrections.

When sought for comment, Chief Prosecutor Michael Ernest said: “Further investigation revealed information which merited a reduction in bail [for Dela Cruz].  We are currently reviewing the case and expect a further filing soon.”

Dela Cruz, 24, was held on charges of rape, and assault and battery.

Associate Judge Ramona V. Manglona raised to $50,000 cash the $25,000 bail earlier set by Associate Judge Perry B. Inos who issued the arrest warrant for Dela Cruz.

Police said Dela Cruz raped his victim on the early morning of Oct. 16 within the Capital Hill area.

Court records showed that Dela Cruz was granted parole on Sept. 16, 2009.

Dela Cruz was sentenced to six years imprisonment, all suspended except for four years, after he pleaded guilty to the sexual abuse of a minor in the second degree on Feb. 20, 2008.
