San Nicolas, 36, failed to comply with the terms of his unsuspended sentence when he was arrested on March 7, 2011 on charges of assault with a dangerous weapon, child abuse, assault and battery, disturbing the peace, and criminal contempt, the AGO said.
On Sept. 10, 2010, Superior Court Judge David A. Wiseman imposed a six-month jail term on San Nicolas, all suspended except for time served at the Department of Corrections facility. The total number of days served by San Nicolas was not mentioned in the judgment and commitment order.
The court also placed San Nicolas on one-year supervised probation after he admitted the charge of disturbing the peace of his common-law wife.
For his latest case, San Nicolas was allowed to post $600, representing 10 percent of his $6,000 bail order.
San Nicolas was charged with slapping and hitting his 16-year-old son with an extension cord.
San Nicolas told police he did not want to leave his son at home because the teenager might go somewhere else.
San Nicolas also told police that his son had been having suicidal thoughts.
His trial was set for Sept. 19, 2011 at the Tinian court house.
