AGO asks federal court to dismiss landowner’s lawsuit vs NMI

In its motion to dismiss, the CNMI government, through Assistant Attorney General W. Allen Hazlip, said the lawsuit filed by Mary Ann Frink should be dismissed because the plaintiff “failed to allege a basis for the justiciability of her claim and has otherwise failed to state a claim upon which relief can be granted.”

Represented by attorney Lilian Ada Tenorio, Frink said despite demands, the CNMI government has not compensated her since  her 525-square meter  property on Nang Ocha Road in San Vicente was taken over by the government in 2000.

Based on records from the Department of Public Lands, the total land compensation owed to Frink as of Sept. 30, 2010 was  $75,498.80, Tenorio said.

She said Frink should be entitled to fair and just compensation for the unlawful taking of her property in an amount equal to the valuation as of the date of taking.
