“We’re not going to move for the dismissal of all of the pending cases being handled [by Leon Guerrero],” Assistant Attorney General George Hasselback told the Variety.
Hasselback at the same time clarified the dismissal without prejudice of Fernando Quitano’s case in connection with the Pink Pawnshop robbery in Chalan Kanoa last Oct. 23.
Quitano was charged with robbery that left two persons injured.
The government moved for the dismissal of Quitano’s case after Leon Guerrero failed to appear during the preliminary hearing.
At the time, Leon Guerrero had been arrested by federal agents for extortion charges.
“The government can re-file the case against Quitano,” Hasselback said.
He said the AG’s office will have another detective/witness for the case.
During the hearing for Zhuo Fan Zhang yesterday, defense attorney David Banes excused himself since he was appointed by the court to serve as counsel for Leon Guerrero in federal court.
Superior Court Associate Judge Perry Inos appointed attorney Steven Pixley to represent Zhang when the hearing resumes today.
Zhang was arrested for conspiracy to commit attempted murder, armed robbery, and assault with a dangerous weapon, in connection with the Pink Pawnshop robbery.
Zhang wife, Xuena Yu, was also arrested.
They were charged with conspiracy to commit trafficking of controlled substance, trafficking of controlled substance, and illegal possession of controlled substance, records showed.
Police named Zhang as the driver of the getaway vehicle that Quitano used in escaping.
Marlon Martin, another robbery suspect, was arrested while trying to escape.
Zhang was arrested on June 7, 2008 for drug charges, police said.
Quitano has been released, while Martin, Zhang and Yu remain under the custody of the Department of Corrections.
