Amended complaint filed vs DPS, former commissioner, former officer

Attorney Robert J. O’Connor, who is representing Jin Dong Wang, said the  government was initially given written notice of the victim’s claim on March 20, 2011, “and the opportunity to investigate and address the claims.”

The commonwealth, O’Connor said, denied the claim on June 7, 2011, allowing his client Jin Dong Wang to proceed with this action.

On Aug. 31, 2011, Jin Dong Wang through O’Connor sued the Department of Public Safety, former DPS Commissioner Santiago F. Tudela, and former Police Officer Jesse Dubrall.

Tudela and Dubrall, as well as 10 Does, were sued in their personal capacities.

In the complaint, Wang is asking for at least $100,000 for general, consequential and compensatory damages, including pain, suffering and emotional distress; punitive damages; injunction directing DPS to implement procedures to prevent the use of excessive force and assault of arrested persons in the future; costs and attorney fees; and other relief.
