The consumer contacted the assistant attorney general designated as the commonwealth’s consumer counsel, Michael Ernest, and complained that on Saturday July 11, the store was offering for sale milk that was “expired in April.”
After a brief investigation, a representative from the AG’s office learned that the store was, in fact, offering for sale expired milk in violation of commonwealth law.
The store owner was contacted and informed of the expired milk.
The store owner immediately instructed his staff to remove the milk from the sales floor, and the AG’s representative witnessed approximately 70 8.5 oz cartons of milk being collected.
While a majority of the cartons were recently expired, at least one carton expired in March.
“What is disconcerting is the fact that the most out-of-date milk was found in the refrigerator, where people would usually expect to see the freshest products,” Michael Ernest said. “This merchant has been made aware of his responsibilities and has promised to do better in the future. I expect that AG investigators will be verifying this store’s compliance in the near future.”
The consumer who filed the complaint was contacted and informed of the results of the investigation.
“The consumer seemed happy with our response and was glad the milk was removed,” Ernest said.
The AG’s office would like to remind merchants that compliance with the commonwealth’s consumer protection statutes is not voluntary and investigators will be out to help ensure that the laws are being followed.
If a member of the public wishes to file a consumer complaint, he or she may call 664-2341. The consumer counsel’s direct line is 664-2333.

Red Cross receives $42,000 from Wal-Mart Foundation
(ARC) — The NMI Chapter of the American Red Cross announced that it received a $42,000 grant from the Wal-Mart Foundation, to be used for the disaster services program to purchase disaster relief supplies to be prepositioned on Saipan, Tinian, and Rota.
The NMI chapter is one of 128 Red Cross chapters awarded funds as part of the Wal-Mart Foundation’s initiative to support disaster response and capacity building projects nationwide.
Given today’s economic uncertainties, this Walmart grant could not have come at a better time.
Despite the fact that Wal-Mart does not even have a store here in the CNMI, they were willing to help our community out.
This really is testament to Wal-Mart’s grass roots beginnings and their belief in giving back to the public.
This should serve as an example to other non-profit and government agencies.
Anything is possible.
