U.S. District Court for the NMI Chief Judge Alex Munson granted defense attorney David Banes’s motion to modify the bail for his client.
Francisca P. Leon Guerrero, the detective’s wife, was named as third-party custodian.
Detective Leon Guerrero, 43, was earlier placed under solitary confinement at the Department of Corrections.
He was directed to issue a $10,000 unsecured bond.
In response to the question of Assistant U.S. Attorney James J. Benedetto, who is prosecuting the case, Mrs. Leon Guerrero said she will immediately inform the court or the Department of Public Safety if his husband violates his release conditions.
Detective Leon Guerrero informed the court that he is waiving any potential conflict and will retain Banes who told the court that he had excused himself from representing a defendant in one of the cases being handled by the detective.
Munson directed Detective Leon Guerrero to “avoid all contact …with any persons who are or who may become a victim or potential witness in the subject investigation or prosecution.”
Leon Guerrero was ordered by the court to report to the Federal Pretrial Service Office for supervision.
He was told not to leave the CNMI or change his residence without the court’s written permission.
Munson set Leon Guerrero’s preliminary examination hearing for Nov. 25.
The jury trial will start on Jan. 18, 2010.
Last week, Leon Guerrero was arrested by federal agents on the charge that he was receiving money from drivers of illegal taxicabs.
