BRIAN Lee, a tour company employee, has been accused of assaulting his common-law partner over the weekend.

Lee, 26, was charged with assault and battery, assault, and disturbing the peace.

At a bail hearing on Monday, he appeared before Superior Court Associate Judge Joseph N. Camacho, who imposed a $20,000 cash bail on the defendant.

The judge also appointed Assistant Public Defender Emily Thomsen to represent the defendant while Chief Prosecutor Chester Hinds appeared for the government.

After the hearing, the judge remanded Lee to the custody of the Department of Corrections. He was ordered to return to court for a preliminary hearing on Dec. 22, at 10 a.m. and for an arraignment on Jan. 8, at 9 a.m.

Judge Camacho likewise ordered the defendant to have no contact with the victim and their four-year-old child.

Background

The victim told police that Lee dropped her off at her work Christmas party visibly upset on Dec. 15 around 7 p.m.

Around 1:30 a.m. Dec. 16, she was picked up by Lee who was shouting at her from inside the car.

She said on their ride back to their apartment, Lee eventually calmed down. Upon reaching their apartment, the victim said Lee used his right hand to push her against the wall, lifting her off the ground for about five seconds.

The victim said she did not resist or say anything to Lee as she did not want the situation to escalate.

Lee then dragged her by pulling her arm into their bedroom and pushing her to their bed. As she lay down on her belly, she said, Lee ripped the dress she was wearing.

The victim said she was not sure how she ended up in the other bedroom, but Lee was pulling her hair at the time.

She said she was crying and was unable to control herself, so Lee dragged her into the bathroom.

She said Lee continued to pull her hair and cover her mouth. Lee repeatedly told her to remain quiet because he was paranoid about the police, she added.

She said Lee sprayed her with water in the bathroom and then dried her off with a towel. She went to their bedroom, lay down and slept.

She said she allowed Lee to do whatever he wanted to do to her because she did not want the situation to get worse.

She told police that it was not the first time that Lee was physical with her. She said “it’s not often, but when Lee gets physical with me, it’s bad.”

She added that on Dec. 14, Lee threatened to kill her, himself, her family, “and whoever the new guy she was dating.”
