Cepeda gets 150 days for sexual assault of a minor

Superior Court Judge David A. Wiseman credited the 11 days already served by Cepeda at the Department of Corrections facility. The original sentence was one year imprisonment, all suspended.

The court ordered Cepeda to serve his sentence without the possibility of parole.

He is expected to be released on Aug. 20, 2011. He will then be placed on three years’ supervised probation.

Cepeda admitted the charge of having unlawful sexual contact with a minor, then 13.

Cepeda will not have any contact with his victim or her immediate family.

He will pay a $500 fine, a $25 court assessment fee, and a probation fee to be determined by the Adult Probation Office.

The court earlier found probable cause that Cepeda may have committed the charge of sexual abuse of a minor in the second degree that carries imprisonment for not more than 10 years, and a fine of not more than $10,000, or both.

The prosecution filed an amended complaint that charged Cepeda with assault and battery.

According to the plea agreement, the crime of assault and battery carries the mandatory minimum sentence involving domestic violence of 72 consecutive hours if the defendant has not been previously convicted of a crime against a person.

The charge also carries 30 days imprisonment if the defendant has been previously convicted, or 60 days of the defendant has been convicted of two or more times of a crime against a person.

A defendant guilty of assault and battery may be punished by imprisonment for not more than one year and a fine of not more than $1,000.

Police said on Feb. 20, 2009, at about 12:40 a.m., Cepeda and the minor were found in the backseat of a parked sedan by Tachogna Beach on Tinian.

Cepeda said he and the minor were about to have sex when the police arrived.

Police found Cepeda’s briefs on the car floor and his belt unbuckled.  He was not wearing a shirt.

The minor told police that Cepeda was her boyfriend.

Assistant Attorney General Russel Lorfing prosecuted the case while Cepeda was represented by Assistant Public Defender Richard Miller.
