Last March, Aguon, 30, was arrested on charges of sexual abuse of minors.
Aguon “should be on our radar from the public safety’s perspective,” CNMI Chief Probation Officer Ursula L. Aldan told the Variety.
“He is not a good candidate [for probation],” she added.
Aldan said Aguon’s sentence was commuted on May 12, 2006, or 10 months before his scheduled release in 2007.
Aguon was sentenced to 10 years imprisonment — five years suspended — for the fatal assault of a man in Kannat Tabla in 2001, and another year of jail term in 2003 after he escaped police custody.
Chief Probation Officer Aldan said another year of imprisonment was added to Aguon’s sentence after he pleaded guilty to escape.
Aldan said the Attorney General’s Office has not responded to her office’s request for clarification on whether an inmate is still under the probation office’s jurisdiction even if the inmate’s sentence has been commuted already.
The Fitial administration has yet to respond to this reporter’s inquiries.
Aguon was supposed to be placed on probation for five years once he completed his prison term.
In July 2000, he was sentenced to five years imprisonment for burglary, all suspended, except for the first four months
He was placed on probation for five years upon his release.
For his latest criminal case, Aguon pleaded not guilty to the charges of one count of sexual abuse of a minor in the first degree, and two counts of sexual abuse of a minor in the second degree.
On Wednesday, the Superior Court scheduled a trial setting conference next month for Aguon.
Assistant Attorney General William Downer is prosecuting the case while Assistant Public Defender Matthew Holley represented Aguon.
Holley has filed a motion for bail modification for Aguon.
His bail has been set at $50,000 cash.
“It has been 55 days since the court imposed the bail and [Aguon] has not been able to meet the bail,” Holley stated in his motion.
The Public Defender’s Office is requesting the Superior Court to release Aguon to a third-party custodian, and to reduce his cash bail to $1,200.
