Court allows continued release of defendants in illegal entry case

Chief Judge William H. Alsup of the Northern District of California at the same time granted the motion of Assistant U.S. Attorney Kirk Schuler, ordering Shixu Huang, Lihua Yi, Zhanshan Zhang and Pingping Zhang not to have any contact with Jingfan Zhang, and his family in China.

Jingfan Zhang was the fifth defendant who became a cooperating witness and testified in court.

Defense lawyers Michael Dotts, Bruce Berline, Anthony Long, and Mark Hanson argued that their clients wanted to seek asylum on Guam.

Alsup ruled that the facts of the case indicated no likelihood for the defendants of fleeing or being a danger to the community.

The prosecution moved for the detention of the four since they were found guilty by a jury.

They are facing a maximum sentence of five years imprisonment.

Sentencing has been scheduled for Sept. 14, 2010.

The defendants have been  released on bail, subject to previously approved pretrial release conditions.

On the early morning of Jan. 30, 2010, U.S. Immigration and Customs Enforcement, the U.S. Coast Guard, and the Rota Department of Public Safety arrested the defendants on two rubber boats while trying to enter Guam through Rota.
