Court asked to evict businessman from property

A BUSINESSMAN yesterday asked the Superior Court to evict another businessman from a property in San Vicente for allegedly breaching their lease agreement and giving him a bad check.

Kim You Sin sued Kim Sang Kuk and his Nathanel Business Marketing Co. for alleged breach of contract and violation of the Bad Check Act of 1984.

Kim You Sin, through attorney Yoon H. Chang, requested the court to order the defendants to pay him $581,000 in damages. He also sought for the termination of the lease agreement.

Chang said her client entered into an assignment of lease with Kim Sang Kuk on Sept. 21, 2001.

Under the terms of the assignment of lease, defendant was to pay an initial deposit of $65,000. The defendant paid a total of $69,000.

Chang said under the terms of the assignment of lease, the defendant could move onto the premises once he paid $65,000.

In Oct. 2001, the defendant took possession of the premises consisting of 5,000 sq. meters of land in San Vicente, Chang said.

Under the terms of the assignment of lease, the defendant agreed to pay the remaining $585,000 within 30 days after the plaintiff provided a preliminary title report, Chang said.

The plaintiff provided the defendant with a preliminary title report on Sept. 27, 2001. The defendant failed to pay the remaining balance due of $581,000 plus interest, Chang said, adding that her client had made numerous requests for payment but the defendant failed to pay.

The complaint alleged that the defendant gave the plaintiff a check dated Nov. 20, 2001 in the amount of $10,000, but the check was not paid due to insufficient funds.

Despite demands, no payment has been made on the check, the complaint said.
