“This court imposed a lawful sentence pursuant to the parties’ plea agreement and its authority under the commonwealth law,” Associate Judge Ramona V. Manglona said.
“[Laniyo’s] failure to timely move for a reduction or reconsideration of the lawful sentence bars this court from exercising any further authority over its sentence,” she added.
Laniyo, 42, entered a guilty plea pursuant to a plea agreement and admitted on June 18, 2008 to the crime of aggravated assault and battery, a crime involving domestic violence in the case.
He was sentenced on Jan. 14, 2009 to serve 10 years of imprisonment, without the possibility of parole, with credit for time served.
On May 18, 2009, Laniyo filed a motion for reconsideration to be granted parole.
