The Attorney General charged Jun Qing Chen, 36, and Yu Hua Wang, 34, with two counts of trafficking of controlled substance, two counts of illegal possession of controlled substance that occurred on Dec. 3 and 5, 2011, and one count each of resisting arrest.
The prosecution said the defendants committed these acts within 1,000 feet of a school.
The court earlier imposed $60,000 bail for each of the defendants after their probable cause hearing last week.
Authorities executed a search warrant that led to the defendants’ arrest in Fina Sisu.
In a separate “ice” case, Yu Hua Wang is due for a jury trial on April 16, 2012, together with co-defendant Le Xiang Chen, also known as Old Man, 60.
Court records showed the AGO has asked the Superior Court to continue trial for these defendants because Le Xiang Chen has been ordered removed pending his appeal. Status of Le Xiang Chen’s removal proceedings is not immediately available.
On Aug. 18, 2010, the Superior Court granted AGO’s motion to dismiss without prejudice the charge of possession and trafficking of “ice” against Yuhua Wang, and Le Xiang Chen after the prosecution did not provide the following discovery as directed by the court: laboratory analysis of the alleged controlled substance seized during the control buy operation, and any information concerning the government’s informant.
In the event the government re-files the charges at a later date, the Superior Court then ordered that a new pre-trial timeline will be set.
The jury trial for Wang and Chen had been scheduled for several times.
On Feb. 27, 2010, Wang and Chen sold “ice” to a DPS confidential source at a hotel parking lot near the Northern Marianas College.
On Feb. 28, 2010, authorities conducted a search warrant at Wang’s room located at No. Wang College and PC café in Fina Sisu, where different paraphernalia were recovered.
