Court grants Miura another extension to file habeas corpus petition

Miura filed his request through his counsel Bruce Berline and the Attorney General’s Office through government prosecutor Jeffery I. Warfield on Aug. 18, a day before the Aug. 19 deadline which the court earlier granted.

Associate Judge Ramona V. Manglona approved Miura’s stipulation after finding good cause and granted the request to move the filing deadlines to Aug. 22, 2008.

Manglona also granted the request to move the date of filing for the government’s opposition from Sept. 2 to 5.

The deadline for Miura’s reply was also moved from Sept. 5 to 8.  

Manglona ordered the hearing date to remain the same, on Sept. 12 at 10 a.m.

Miura appeared in court on June 19 with his lawyers Berline, Mark B. Hanson and William M. Fitzgerald to apply for release on bail, which the court denied pending a determination on his proposed petition for a writ of habeas corpus.

The court held that Miura is in the custody of the CNMI Department of Corrections on a governor’s arrest warrant awaiting extradition to the state of California.

Gov. Benigno R. Fitial signed the arrest warrant for Miura on March 12, 2008 as a response to a formal rendition by the governor of California.

On May 28, Miura reaffirmed his intention to challenge the extradition by way of a habeas corpus petition filed in court on May 28, indicating that he would apply for release on bail.

Miura is facing charges of murder and conspiracy to commit murder in California for the death of his wife in Los Angeles in 1981. He was acquitted of the crime in Japan later.
