Naraja has granted the motion to dismiss filed by Chief Prosecutor Michael Ernest who told the court “the commonwealth believes it is in the interest of justice to dismiss this case without prejudice at this time.”
This means the Attorney General’s Office can re-file the case against Tydingco.
During a hearing on April 29, 2011, Judge Perry B. Inos “found that the commonwealth presented sufficient evidence to support the lawful arrest and detention of [Tydingco] on the charge of disturbing the peace.”
Assistant Public Defender Richard Miller served as counsel for Tydingco.
