Associate Judge David A. Wiseman said Conrad Borja Iba must post 10 percent or $1,000 cash bail and the remaining $9,000 in unsecured bond for his temporary release.
Iba appeared in court with Assistant Public Defender Richard C. Miller while the government was represented by Assistant Attorney General Katie Busenkell.
Wiseman set the arraignment for Dec. 15 at 9 a.m. if the defendant is not released, and the preliminary hearing for Dec. 9 at 1:30 p.m.
The defendant was ordered to return to court whenever required to do so, obey all commonwealth laws and have no direct or indirect contact with the victim.
The charges against the defendant stemmed from the affidavit filed by Police Officer Barbara K. Arend of the Department of Public Safety’s Criminal Investigation Division on Tinian.
Arend stated that at about 1:24 p.m. on Nov. 29, DPS received a call requesting for assistance.
The female caller told police that earlier that night, her boyfriend, Iba, was engaged in a drinking spree with two other individuals outside her house.
At about 11 p.m., she said the defendant came into the bedroom, pulled her hair and dragged her around the bedroom.
She told police that the defendant slammed her against the wall twice, punched her and choked her.
She said this happened in the presence of her son, who was crying.
She added that the defendant had drank more than a case of beer that night.
The said the defendant broke her phone when she tried to call the police, and blocked the door when she tried to get out.
She said she was only able to free herself by getting out through the window.
In a supplemental affidavit, Police Officer Laura Cruz stated that the victim had scratches and bruises on her neck, face, arms, and other parts of the body. She was taken to the hospital after she complained of pain in her head.
Arend believes that probable cause exists to support the charges of assault and battery, disturbing the peace, interfering with a domestic violence report, and contempt.
In 2005, Iba was placed on three-year probation for a domestic violence case. On Oct. 10, 2008 the probation was extended to April 30, 2009.
