Court urged to take no action on ex-convict who tested positive for ‘ice’

Juan Akiyama Aldan has been returned to the Federal Probation Office Drug Testing Phase Program and will be immediately referred to counseling, according to Federal Probation Officer Melinda B. Santos.

On Dec. 17, 2010, base on  his quarterly drug testing, Aldan tested presumptive positive for the presence of methamphetamine.

Aldan is scheduled to complete supervision on Feb. 28, 2011.

Santos said Aldan admitted to smoking “ice” earlier that day and signed a written admission.

On Dec. 20, 2010, Aldan reported to the Federal Probation Office for a noncompliance meeting.

“He accepted full responsibility for his relapse and asked for help in dealing with his addiction. Mr. Aldan explained he is a recovering addict,” Santos told the court.

Aldan recently began part-time employment.

Aldan “is constantly surrounded by people who talk about ‘ice’ or ask him to hang out after work and drink beer. He believes that listening to people talk about drugs weakened his resolve and caused him to lower his defenses,” Santos stated in her report.

Aldan used the extra money he earned to purchase “ice,” Santos added.

Aldan regretted his decision and is willing to return to drug counseling and random testing, Santos said.

On Feb. 8, 2000, then-Chief Judge Alex R. Munson imposed an 18-month jail term on Aldan for each count of conspiracy to distribute methamphetamine and possession with intent to distribute methamphetamine, to be served concurrently, followed by six years of supervised release.

On June 27, 2005, the federal court revoked Aldan’s supervised release as a result of a new criminal conduct — dealing “ice” — and sentenced him to 30 months imprisonment followed by 42 months of supervised release with conditions previously imposed.

Aldan’s supervision started on Aug. 30, 2007.
