Defendant in driver’s license case booked for marijuana possession

Miah, who was indicted for conspiracy and unlawful production/transfer of CNMI driver’s license, was arrested by the Department of Public Safety on May 25, 2011 on charges of rape and illegal possession of marijuana, according to court documents.

The victim later told police that she made a false claim, and the rape charge was dropped.

Detective Roque Camacho told Federal Probation Officer Gregory Arriola that the victim claimed that Miah picked her up at about 4:30 p.m. and brought her to the defendant’s residence.

Police searched Miah’s residence and found traces of marijuana in his room.

Marijuana was also found on the victim, court document stated.

The U.S. Probation Office was informed that marijuana residue and a marijuana tree with its leaves removed were found inside Miah’s room.

A potted marijuana plant was also found at the back of his residence.

The charge of illegal possession will be forwarded to the CNMI Attorney General’s Office, local police told the U.S. Probation Office.

It was not mentioned if  the victim will be charged with making false claim or illegal possession of marijuana.

Miah told his probation officer that he did not deviate from his location monitoring schedule.

On May 26, 2011, Miah, then under the custody of the Department of Corrections, was submitted to a drug test, and the result indicated negative of any illicit substances.

Miah was booked and released on same day, according to court documents.

Last March, the U.S. District Court for the NMI placed Miah on house arrest subject to pretrial release conditions and electronic monitoring.

He was authorized to leave his home for work from 1 p.m. to 5 p.m.

He was required to issue a $5,000 personal security bond, to be co-signed by his wife Tahira Dolores Miah, a co-defendant in this case.

Mr. Miah’s jury trial has been rescheduled for Sept. 12, 2011.
