Melvin David Diaz through his court-appointed defense attorney Joseph Horey told the federal court that Guam is a more convenient venue for him “because it is his home and lifelong residence, and it is where all of his close family members are also residing.”
On Guam, Diaz said he would be able to provide a custodian or other security as the court might require in order to secure his release pending trial, “and thereby maintain his employment and continue the support of his children.”
If not, his family would be able to visit him in detention, attend his trial, and to provide such moral support to him as they are able, Diaz told the court.
Guam is also more convenient venue for the alleged victim and other witnesses, all of whom either reside either on Guam or on Rota, Diaz said.
Diaz, who remains in the custody of the U.S. Marshal Service, has denied the charges.
