Driver sued for hitting another car

Kim Chang Sook and his wife Kim Jae Won filed the complaint against Nobuyuki Kurosawa.

They are asking the court to award them judgment against the defendant in an amount to be proven at the trial of this case, for their court costs and for interest on the total damages at the maximum rate provided by law from the date of judgment.

The plaintiffs, through their counsel, Michael A. White, stated that the Toyota Camry  operated by the defendant stuck their car from the rear when they stopped for cross traffic at the intersection of Beach Road and Chalan Monsignor Guerrero at 3:31 p.m. on March 17, 2008.

The plaintiffs added that as a direct result of the defendant’s negligence, Kim Chang Sook suffered severe injuries and will continue to suffer severe physical and mental pain and anguish. He has also suffered other damages, in an amount to be proven at the trial of this case.

Also, as a result of the defendant’s negligence, plaintiff Kim Jae Won has been deprived of the companionship of her husband, their complaint stated.

 The couple said the accident caused them to spend, and they will continue to spend, considerable sums for the care and treatment of the injuries Kim Chang Sook suffered.

  The defendant has 20 days to answer the charges in court after the summons was served on Dec. 19, 2008.

The summons stated that if the defendant fails to file an answer during the given time, judgment by default could be rendered in favor of the plaintiffs.
