Driver who caused quadruple auto collision on Beach Road sued

Xian Guo Zhao, through his counsel David G. Banes, sued Daniel Asare Mensah.

Zhao is asking the federal court to grant him relief for general, statutory and special damages in an amount to be proven at trial, for pre-judgment and post-judgment interests as allowed by law, for costs of suit and for other relief the court may deem just and proper.  

Zhao said on Sept. 28, 2007, he was traveling along Beach Road heading toward south onboard a Chevrolet passenger van when Mensah, who was driving a Honda sedan hit his van in the rear.

As a result of the impact, Zhao said his van moved forward and hit the vehicle in front of him, which in turn hit another vehicle in front.

Zhao said the accident resulted to his injuries and the vehicle he was driving was severely damaged.

Zhao was taken to the Commonwealth Health Center for treatment.

He suffered pain on his neck and head, and he had lacerations on his forehead.

Zhao said the Department of Public Safety police officer who investigated the accident concluded in its Traffic Crash Report that Mensah was at fault.  

Zhao said Mensah, “with reckless indifference to the safety of others, recklessly and carelessly operated his car and failed to keep a proper lookout for other users of the road.”

He said Mensah violated CNMI’s vehicular laws.

Zhao is filing a cause of action against Mensah for negligence which caused him damages such as lost wages, and he continues to suffer severe and permanent physical and mental pain and anguish, all to his damage in an amount to be proven at trial.
