San Nicolas slapped his son, and hit the victim with an extension cord on Feb. 18, 2011.
Superior Court Judge David A. Wiseman ordered San Nicolas to start serving the remainder of his prison term on Jan. 10, 2012. The judge credited seven days San Nicolas already served at the Department of Corrections facility.
Wiseman originally sentenced San Nicolas to one year imprisonment, but all suspended except for 60 days.
As part of the plea agreement, the remaining charges of assault with a dangerous weapon, child abuse, disturbing the peace and criminal contempt were dismissed.
Assistant Attorney General Russel Lorfing prosecuted the case, while Assistant Public Defender Douglas Hartig served as San Nicolas’s counsel.
San Nicolas will pay a $ 100 fine as well as all mandatory court and probation fees.
He will be placed on one year probation.
San Nicolas will report to the Community Guidance Center for anger management counseling and will complete recommended treatment.
