Ex-Finance secretary sues Palms Resort

The couple is demanding for compensatory damages to be determined at jury trial and is represented by attorney William M. Fitzgerald.

According to the complaint, the couple with their daughter and an infant son went to Palms Resort to celebrate Mother’s Day on May 9, 2010.

After having a meal at a restaurant at the ground level below the lobby, they proceeded to the elevator area on their way to the first floor lobby.

When the elevator opened, the daughter rushed inside and the door quickly closed before her mother could accompany her, the complaint stated.

The mother rushed to the stairs to see her daughter while the father who had the infant took the next elevator up.

The daughter had gotten off the elevator on the first floor where she then looked for her parents.

No hotel staff or security guard came to offer her assistance, the complaint stated.

The daughter, hoping to see her parents, climbed onto a flower holder, which overlooked the ground level of the hotel.

“Because there was no protective bar as (the victim) stood up, she lost her balance and fell violently to the ground level, landing in a patch of flowers, miraculously missing various sharp concrete surfaces,” the complaint stated.

The couple said their daughter was bruised, broken and seriously injured.

“After a period of time had passed, an ambulance arrived, the victim was placed on a backboard and taken to the hospital where she was found to have suffered numerous bruises and contusions, as well as fractures of her arms and legs,” the complaint added.

The hotel is being sued for negligence by failing to provide safeguards that would render its facilities free from hazardous conditions.

Palms Resort has been closed since October 2010 for “renovations.”
