Assistant Attorneys General David Lochabay and Gil J. Birnbrich yesterday asked visiting federal Senior Judge Robert T. Bryan to temporarily withhold the execution of judgment in favor of Emerenciana Peter-Palican until all post-trial motions are resolved.
The federal court earlier ruled in favor of Peter-Palican and ordered the CNMI government to pay her over $245,000 representing her back wages and certain benefits lost, as well as attorney’s fees and costs.
The CNMI government was also ordered to appoint or hire Peter-Palican within 30 days of its judgment to a commonwealth government position at a salary equal to or greater than what she had as special assistant for women’s affairs.
The court said she will be “awarded the full panoply of rights and concomitant responsibilities she previously enjoyed as special assistant, including annual leave and sick leave benefits, health and life insurance benefits, and participation in the Retirement Fund.”
Peter-Palican was an appointee of the previous administration.
