Federal Judge Manglona hears cases

Manglona scheduled the jury trial for Dong Jun Li on Oct. 3, 2011.

Dong Jun Li, who is being represented by court-appointed defense attorney Mark Scoggins, denied the charges of immigration document fraud and false statement or entry.

The defendant was assisted by a Chinese interpreter.

Assistant U.S. Attorney Beverly McCallum, who is prosecuting the case, asked the court for Dong Jun Li’s continued detention, which the judge granted.

Last month, the U.S. Immigration and Customs Enforcement arrested Dong Jun Li who was charged with presenting a fraudulent advance parole document in his attempt to board a plane to Los Angeles, California.

In the violation hearing,  Manglona granted the petition of the U.S. Probation Office to modify pretrial release conditions of Mohammad Jahangir Miah.

Miah, who was assisted by a Bangladeshi interpreter, admitted the violation of possession of “less than an ounce of marijuana” on May 25, 2011.

Assistant U.S. Attorney Kirk Schuler, who is prosecuting the case, Miah’s court appointed-defense attorney Joseph Horey, and a federal probation officer met with Manglona before she approved  modified release conditions for Miah.

The court ordered Miah to truthfully answer all inquiries and to follow instructions by the Federal Probation Office.

Miah will refrain from any alcohol, and submit to testing that included use of prohibited substance.

He will refrain from use or unlawful possession of a narcotic drug or other controlled substances.

Miah will not have any contact with certain individuals who are or who may become a victim or potential witness in the subject investigation or prosecution.

Miah will advise the U.S. Probation Office if he is a victim of a crime, and he will adhere to all orders of the CNMI Superior Court regarding his domestic cases.

Miah has denied the charges of conspiracy and unlawful production or transfer of CNMI driver’s license.

The federal court rescheduled Miah’s jury trial for Sept. 12, 2011.

Manglona told Miah that the court was very hesitant in accepting the recommended modification, but said it was a fair resolution of the violation hearing and other consideration factored in.

Manglona reminded Miah to appreciate his liberty since he is under strict court order.
