Fitial said he is expecting the regents to come up with their position on McPhetres’s resignation which the board accepted after she rescinded it.
“If they declare vacancy I have to make an appointment,” the governor told Variety.
He reiterated that he never received McPhetres’s resignation letter.
Fitial said he and the former NMC president “both agreed that her resignation would not serve the best interest of [the college] and the CNMI community.”
NMC Chairman Charles V. Cepeda said the issue is still being review by their legal counsels.
Press Secretary Charles P. Reyes Jr. said the governor is looking forward to the regents’ reconsideration of their decision regarding McPhetres.
He said the governor also wants to know the opinion of the regents’ counsels.
“The legal question is whether the resignation can be effective if it was never actually served upon the governor. Who is the party with legal standing to receive and trigger the resignation? The governor, who is the appointing authority, who nominates all regents, or the board?” Reyes asked.
