Former cop on house arrest asks court to help ailing relative

Francisco S. Pangelinan has been placed under house arrest and electronic monitoring program since May 2011.

Court-appointed defense attorney Robert T. Torres said Pangelinan’s wife and family need his support and assistance.

Pangelinan’s grandmother is gravely ill and he would like to attend to her as well as assist with the transportation and care of his daughter, Torres told the court, referring to his client.

Torres said Pangelinan has been in full compliance with all conditions including drug testing, substance abuse counseling and treatment, and all other provisions.

Torres also asked the federal court to reschedule Pangelinan’s jury trial because the FBI case agent will be unavailable for the Dec. 19, 2011 trial.

Also, Assistant U.S. Attorney Frederick Black has just entered his appearance for this case, substituting for Assistant U.S. Attorney James J. Benedetto, the original prosecutor, who has relocated to East Timor.

Pangelinan has denied charges of deprivation of rights under color of law for excessive force, and false arrest.

On July 6, 2010, Pangelinan, then a police officer, pepper sprayed Felipe “Phil” Kalen and Alafanso Anso Kintin that resulted in their bodily injury, according to the indictment.
