Yama’s Co., which is doing business as Saipan Yama’s Co., also wanted a jury trial for Makoto Hirata, who served as the firm’s general manager from April 2006 to July 2009, and a member of its board of director from Oct. 2006 to July 2009.
The complaint filed by attorney Judy Torres said Hirata started to embezzle company funds beginning in Dec. 2006, involving the amount of $105,236.
The company provides transportation services on island.
The complaint stated that Hirata declared purchases for the operation of the company, “when in fact the purchases were for [Hirata’s] personal gain and use.”
The unauthorized purchases included, restaurant meals, dog food, utility payments for Hirata’s own residential unit, and a stone ring, the complaint stated.
When the embezzlement was discovered in Dec. 2009, the company confronted Hirata who “admitted wrongfully using $105,236” of company funds in a letter to its president, the complaint added.
The company is asking relief for breach of fiduciary duty, conversion, and/or embezzlement and fraudulent misrepresentation, special damages in the amount of $105,236, damages, costs and attorney’s fees, and other relief.
