Govendo sets $10K bail in assault case

Associate Judge Kenneth L. Govendo ordered Hua Feng Sun to post 5 percent or $500 of the bail in cash and the remaining $9,500 in unsecured bond during the bail hearing on Friday morning.

Chief Public Defender Adam Hardwicke was appointed to represent the defendant.

Govendo  ordered the defendant to return to court whenever required to do so, obey commonwealth laws and not leave Saipan without court permission.

He must keep all appointments with his attorney and must have no direct or indirect contact with the victim.

The defendant must return to court for a preliminary hearing at 9 a.m. today. His arraignment is set for Nov. 16 at 9 a.m.

The Attorney General’s Office found probable cause to charge the defendant with disturbing the peace, assault and battery and aggravated assault and battery. The AGO also recommended a bail of $25,000. 

In his affidavit, Detective Jackson W. Jack said that at about 12:47 a.m. on Oct. 30, 2009, the Department of Public Safety received a telephone call reporting an assault and battery incident in Garapan behind the former GIG club.

Investigation showed that the defendant and the victim, Huang Xua, were  playing mahjong at the Rui Jin Store.

Huang won the first game but the defendant did not want to pay what he owed which was $200. They got into an argument and the defendant left the area.

About 30 minutes later, the victim walked out of the store and went toward 777 Poker game room when he felt something hit the back of his head.

The victim fell to the ground and the defendant threw himself on top of the victim.

Jack’s affidavit said the defendant choked and punched the victim’s face several times, grabbed his shirt and started pushing him to the ground. The victim was taken to the hospital for treatment.

The victim went to  DPS at 10:14 a.m. on Oct. 30.

Jack said the victim had bruises on his chest, back and elbow.

He also had bruises on his eyes and a laceration on the right side of his head.

He limped as he tried to walk.

The victim identified the defendant from photographs provided by the Attorney General’s Office Investigation Unit.
