Guam DPW director opposes road block bill

Opposing the measure was Department of Public Works Director Joanne Brown.

“The current language of Bill 341 is fairly general without identified parameters or procedures, other than authorizing mayors to block or close non-routed roads within their village without having to obtain a highway encroachment permit from DPW,” Brown said.

“While funerals and fiestas are identified as allowable activity, the addition of the words ‘other events’ is undefined. How will notice be provided to motorists when roadways are blocked? How will ambulances and police vehicles be able to travel through secondary roads when roads are closed or blocked off?” Brown added.

She further asked who would be liable if there is a vehicle crash in an area where the road is blocked off.

“The priority of DPW as a government entity responsible for public easement and roadways is to prioritize the safety and welfare of the driving public,” she said.

Brown also said there are currently about 109,000 vehicles on the road.

Speaking in favor of the measure were members of the Mayors Council Including Sinajana Vice Mayor and Mayors Council Vice President Robert Hofmann, Yona Mayor Jose ‘Pedo’ Terlaje, and Yigo Mayor Robert Lizama.

Terlaje commended Cruz for introducing the measure, adding he is in support of the bill.

Terlaje said it is easier for constituents to go to the mayors for assistance instead of DPW.

“Second, the mayors and vice mayors can easily monitor the traffic situation and make modifications if needed. If a hazardous or life situation does exist during the closure, the mayor or the vice mayor can immediate make the necessary changes,” Terlaje said. “Usually the road closure is on weekends. DPW is not present to make those changes if needed. DPW is not monitoring the traffic situation in the villages.”

Terlaje stressed the mayors know their limitations and would never close main routes like Route 1 or Route 4.

The bill has been referred back to committee for further review and amendments.
