The two companies filed a one-start application to start developing a plot of land they leased to become a staging area.
On the application, the companies stated the site would be graded and excavated by heavy equipment and that the excavated material would be reused, but failed to indicate that they would be using the site as a quarry for commercial projects.
In Feb. 2008, upon investigating complaints of quarrying activities at the GPPC leased site, CRM sent GPPC an enforcement notice advising they could not further excavate materials from the site without a major siting permit.
The companies appealed this decision, but the court determined that requiring a permit application is not a final agency action and dismissed the action.
