Illegal alien indicted on Saipan arrested on Guam

CAIPING Guan, who was indicted on Saipan in 2022 for entering Guam illegally by boat, was arrested in the U.S. territory on Monday, Jan. 27, 2025.

Guan was charged with conspiracy to transport illegal aliens. A petition has been filed to remove him from Guam and transfer him to Saipan.

The defendant is scheduled to appear before Magistrate Judge Heather L. Kennedy in the District Court for the Northern Mariana Islands for an arraignment on Feb. 5 at 3 p.m.

His co-defendants, Guoqin She and Youhou Luo, pled guilty to the charge of conspiracy to transport illegal aliens on Nov. 17, 2022. 

On Dec. 13, 2022, Chief Judge Ramona V. Manglona of the District Court for the NMI sentenced She to time served of 31 days and two years of supervised release. She was also ordered to pay a special assessment fee of $100. 

Luo was sentenced to time served of 32 days and two years of supervised release. He, too, was ordered to pay a special assessment fee of $100. 

Both defendants were ordered to perform community service in lieu of fine, but this requirement shall be waived if the defendants voluntarily depart within the time frame pursuant to the plea agreement. 

Luo’s supervised release was recently terminated.

As for She, a warrant for his arrest was issued in July 2023 for violating supervised release conditions.

According to the U.S. Probation Office, the defendant failed to voluntarily depart the United States within six months following his sentencing date and failed to report to the U.S. Probation Office as instructed to provide proof that he applied for a new People’s Republic of China passport. 

Moreover, She changed residence without properly notifying the U.S. Probation Office and failed to submit a monthly supervision report for June 2023.

According to the indictment, on or about July 20, 2022, She and Luo, “along with four other citizens of the PRC who also did not have legal immigration status, pooled money together to purchase a boat for $22,000 on the island of Saipan in the Commonwealth of the Northern Mariana Islands (CNMI). The boat, which had CNMI boat registration number CM 4847 PU, was used by the six Chinese citizens to complete transportation from the CNMI to Guam on or about July 23, 2022. A boat was used for transportation because the Chinese citizens wanted to avoid immigration processes that [were] anticipated if travel was completed by commercial airplane. Authorities located the boat after it came ashore to Guam from the CNMI with all six Chinese citizens on July 23, 2022.”
