Investment firm sues another company for $358,830 in unpaid rent

Ace Investment Group, which is doing business as Star Sands Plaza, filed the complaint before the Superior Court against Lacita Corporation.  

The plaintiff, with its counsel Joaquin DLG. Torres and Judy DLG. Torres, is asking the court to order the defendant to grant them relief of $358,830 for the unpaid rent, CUC power bill, bond and credit card fee; for pre and post judgment interest of 12 percent per annum; for an order to evict the defendants from the premises and for the plaintiff’s recovery possession of the premises and for double the minimum rent for the duration of that the defendants holdover the premises.

The plaintiff further asks the court to issue a Judicial Lien in its favor on the defendant’s assets and on the fixtures, merchandise, goods, inventory and equipment on the premises for the value of an amount to be proven at trial, for fines and fees according to the terms of the Lease Agreement, for incidental and consequential damages, for attorney’s fees and costs of suit and other relief.

The complaint stated that the plaintiff entered into a Lease Agreement with the defendant on Jan. 22, 2008 for a 929-square meter lot in Garapan which became effective on the first day of business on April 1, 2008.

The plaintiff said that the defendant promised to pay on the first of each month for the months of April, May and June 2008. Further, the defendant promised to pay the plaintiff $34,911 on the first day of each month starting July and for the remaining term of the Lease Agreement.

The defendant also promised to provide a security deposit divided into three payments of $34, 911 at the time the agreement was executed, the same amount for March 30, and $27,716.71 for June 30, 2008.

The plaintiff said the defendant also agreed to provide them a certified written statement of its total gross sale at the end of the month during the preceeding lease year, to pay 12 percent per annum interest fee for unpaid amounts, and that the plaintiff is entitled to assess a $50 service fee for each late payment.

The plaintiff said the defendant agreed to pay all utility services including gas, electricity, water, sewer, light, heat, power, telephone or any other services used in the premises.

It added that as of July 8, 2009, the business that is operated on the said premises is not Lacita Corporation.
