Dr. Anthony Stearns of the Marianas Medical Center filed the complaint against Micronesian Health Corp., which is doing business as Island Medical Center on Saipan.
IMC was shut down in March for violating sanitation rules and faking laboratory test results for foreign workers, but it reopened in October after the Department of Public Health lifted the suspension order.
Public Health has said that IMC’s laboratory service remains suspended.
MMC, represented by attorney Michael A. White, is asking the court to award Stearns the principal sum, interests, reasonable attorney’s fees, court costs, and for interests on the total of the foregoing amount at the maximum date provided by law from the date of judgment.
The plaintiff said both parties entered into a contract for services on Dec. 12, 2003 but the defendant “failed, refused and neglected” to pay the principal sum of $49,699.16 or any part of it.
The plaintiff said the defendant is in default and now owes him the principal sum plus interests thereon from July 2008.
Court documents showed that MMC provided the defendant with laboratory services like stool ova and parasite, stool culture, HIV/Antibodies, serological test for syphilis and other laboratory tests.
The plaintiff said they agreed to process all the laboratory specimens they received from the defendant in a timely manner and treated all its clients fairly with regard to the processing of specimens and release and transmittal of results.
IMC is ordered to file an answer to the complaint in 20 days or face judgment by default for the relief demanded in the complaint.
