Traffic Officer Norris Kwon told the Variety he had already submitted his report to the Attorney General’s Office which will determine if legal action will be taken against the driver or the owner of the vehicle, a red 2001 Toyota Highlander, that fatally hit Joe on the evening of Oct. 2.
Police earlier ruled out speed and alcohol on the part of the driver, Ham William Hambros, 19, who is said to be a son of a police officer.
Hambros was not issued a citation nor arrested after the incident.
Police said the 26-year-old Joe had a .213 blood alcohol content.
In the CNMI, the legal BAC limit is .08.
Variety learned that Hambros, after the incident, initially told police that he never saw anybody crossing the street until an individual, later identified as Joe, walked in front of his vehicle.
Variety was told that Joe, coming from Mom’s Round Two bar, was hit on the center lane of Garapan St.
Joe succumbed to head injuries a day after he was rushed to the Commonwealth Health Center on Oct. 2.
The family will bury Joe in Kagman after a 10 a.m. Mass at the CHC chapel this Friday.
