Joseph Arriola Jr. gets 90 days for perjury in Tinian rape case

Last September, Judge David A. Wiseman convicted Arriola of sexual assault in the third degree in connection with the sexual assault incident at the Tinian cemetery.

The court has yet to impose sentence on Arriola for that case. The offense carries a maximum sentence of five years in prison, the prosecution said.

For this case, Wiseman sentenced Arriola to six months imprisonment, all suspended except for 90 days to run concurrently with his first criminal conviction.

The sentencing for this case was deferred until Arriola’s sentencing in his other case.

Arriola is currently out on bail.

The court ordered Arriola to pay a $100 fine, a $100 court assessment fee, and a probation fee to be determined by the Adult Probation Office. He will be placed on two years’ probation.

Assistant Attorney General Russel Lorfing prosecuted the case, while attorney Joaquin Torres was the court-appointed defense counsel.

The Attorney General’s Office charged Arriola with two counts of perjury during the jury trial for his co-defendant Kurt B. King on Dec. 2, 2010.

Arriola claimed “he had never stolen anything, never burglarized, or never stole from family,” and that “he never assaulted the victim contrary to a signed plea agreement.”

Police arrested King and Arriola on charges of kidnapping and raping the victim at the Tinian cemetery after a drinking bout with her friends.
