Superior Court Judge David A. Wiseman originally imposed three years’ imprisonment on Deleon Guerrero, but suspended two of them.
Deleon Guerrero has admitted the charge of sexual assault in the third degree in the first amended information filed by the Attorney General’s Office.
The AGO originally charged Deleon Guerrero with one count of sexual abuse of a minor in the second degree, and disturbing the peace.
The court at the same time vacated the Nov. 14, 2011 jury trial for Deleon Guerrero who will register as a Tier One sex offender.
Deleon Guerrero is expected to be released from the Department of Corrections facility on Nov. 7, 2012.
He will be placed on four years probation.
If Deleon Guerrero completes all conditions of his supervised probation without incident, and if he relocates to Guam, the sentence of probation will be reduced to three years of unsupervised probation, the court ordered.
Deleon Guerrero will not have any contact with his victim before she reaches the age of majority.
Deleon Guerrero will have no unsupervised contact with any minor during the period of probation.
He will stay at least 500 feet away from the victim, and the victim’s immediate family, for the duration of his probation.
He will not enter the property/residence of the victim.
Deleon Guerrero, moreover, will undergo sex offender counseling at the Community Guidance Center, and will complete any recommended course of treatment.
The court imposed a $1,000 fine that will be reduced to $500 if Deleon Guerrero pays in full before his release from prison, a $100 court special assessment fee, and a probation fee.
Assistant Attorney General Russel Lorfing prosecuted the case, while Assistant Public Defender Douglas Hartig served as Deleon Guerrero’s counsel.
Detective Jonathan Decena said the incident occurred on June 7, 2011.
Police responded to a disturbance call to the residence of former Mayor Jesus Deleon Guerrero on Happy Lane in Kagman.
Responding officers were told of a commotion or fighting inside the house.
The victim’s father approached the officers and said his daughter woke him up, complaining that Deleon Guerrero inappropriately touched her at about 2 a.m.
Further investigation showed that Deleon Guerrero also sexually assaulted the victim in 2007 and 2008 while they were in Oregon.
The victim said Deleon Guerrero would carry her home after their family rosary, and this was when Deleon Guerrero would inappropriately touch her.
The victim, now nine, was too afraid at the time to tell anyone about the incidents, Decena said.
