Joyner to change plea in assault case

Superior Court Associate Judge David A. Wiseman granted the stipulation of both parties to move Joyner’s change of plea hearing that was earlier scheduled for Aug. 4.

Joyner was charged with attempted aggravated assault and battery, two counts of assault and battery, criminal coercion, interfering with a domestic violence report, assault, and violating an order of protection.

The Attorney General’s Office said Joyner “violently attacked Minna Mendiola Camacho in the presence of their minor child…while threatening to kill her” on Sept. 4, 2008.

On Feb. 7, 2009, the AGO said Joyner “threatened…Camacho that he would come to her residence, physically assault her and kidnap her children.”

Joyner is represented by Joseph James Norita Camacho while Assistant Attorney General Brian D. Gallagher is the prosecutor.

According to the plea agreement filed in court last July, Joyner will plead guilty to assault and battery, while the CNMI government will move for the dismissal of the remaining counts against him.

The proposed sentence is one year incarceration, all suspended, except for the first three months.

“This term shall be concurrent to the term which [Joyner] is serving on unrelated charges prosecuted by the United States Department of Justice,” the plea agreement stated.

Joyner is currently serving his six-month jail sentence at the federal penitentiary in Adelanto, California, which is a high security facility for male inmates.

Joyner pleaded guilty to three counts of possession of a controlled substance with intent to distribute after he was arrested by the U.S. Drug Enforcement Administration in Oct. 2009.

The federal ordered Joyner to start serving his sentence on May 26, 2010.
