Jury trial of man in marriage fraud case ongoing

Defendant Minto Minto’s lawyer is Steven Pixley while the government was represented by Assistant Attorney General Melissa Simms.

The trial started on Monday.

Minto is one of the four defendants charged with conspiracy to commit marriage fraud and solicitation.

The other defendants were Maria Aurelio Ray, Saiful Islam and Munnaf Miah.

According to the information filed by the AG’s office in court, Ray, Islam and Minto unlawfully agreed that Islam would marry Alisilynn Mallens for the sole purpose of obtaining labor and immigration benefits in March 2007.

Ray, Miah and Minto were also charged for conspiring with each other to arrange Miah to marry Severene Kosam for the same purpose of obtaining labor and immigration benefits on the same month.

Miah was found guilty of soliciting marriage fraud but he was acquitted from charges of conspiring with other persons to commit marriage fraud last month.

Superior Court Associate Judge David A. Wiseman ordered the Adult Probation Office to prepare a pre-sentence report for Miah.

He will be sentenced on Sept. 17 at 9 a.m.

Last May, the jury found Ray guilty of two counts of conspiracy to commit marriage fraud, but acquitted her on two counts of solicitation.

The court set the jury trial for Islam on July 21, but the defendant fled to Bangladesh before the trial could take place.

Based on the affidavit of immigration investigator Erwin Flores, defendant Ray and her husband Minto Minto approached Severene Kosam on March 14, 2007 and asked her if she was interested in marrying someone in exchange for money.
