Landowner in jail, again

U.S. District Court for the NMI designated Judge Juan T. Lizama on Friday morning revoked John S. Pangelinan’s supervised probation for failing to pay his assessment fee, failing to show for drug and alcohol testing, and not allowing a probation officer to visit him at home.

Pangelinan also failed to pay his fine amounting to $7,500.

He appeared for a revocation hearing on Friday with attorney Steven Pixley.

Lizama ordered Pangelinan remanded to the custody of the U.S. Marshal Service.

Pangelinan was indicted on two counts of obstruction of a court order for writing a letter to the editor that warned the public from purchasing his land that was to be auctioned by the court.

A federal jury found him guilty of the charges and U.S. District Court designated Judge David A. Wiseman sentenced him to one year of imprisonment for each count to run concurrently.

The judge also placed him on one year of supervised release after completing his jail term.

Pangelinan was released from the Bureau of Prisons in January and was arrested later for not complying with the terms and conditions of his probation such as to report to the U.S. Probation Office 72 hours after his release.

In January, Pangelinan filed a multi-million-dollar lawsuit against U.S. District Court for the NMI Chief Judge Alex Munson, Wiseman, U.S. Assistant Attorney Craig Moore, U.S. Probation Officers Margarita DLG. Wonenberg and Melinda N. Brunson, Federal Bureau of Investigation agent Joseph Auther, U.S. Marshals Donald Hall and Wolf Calvert, grand jurors 11 through 23,federal jurors one through 12, Roy Alexander, Robert Torres, Lillian A. Tenorio and Rufo T. Mafnas.

Pangelinan also filed a Bivens action against federal officials and agents, and private individuals. A Bivens action allows an individual to bring suit against federal officials for deprivation of his constitutional rights.

The federal court dismissed his lawsuit saying it was “repetitive, meritless, vexatious, abusive and burdensome.”
