Lawyer, man sued over botched land deal

Plaintiff Sin Ho Nam named attorney Ramon K. Quichocho and Joaquin Q. Atalig as defendants in the civil action filed  yesterday.

Nam through attorney Colin M. Thompson accused Quichocho and Atalig of breach of fiduciary duty, breach of contract, and restitution.

Nam is demanding a jury trial.

Asked for comment, Quichocho said he had yet to be served a copy of the civil action.

The matter involved a 55-year lease by Nam on a real property owned by Quichocho near Ladder Beach.

Thompson said Nam paid the full rental price of $218,000 in exchange for leased premises.

The deal started in 2007 when Nam first met Quichocho who broached the idea of leasing the real property owned by the lawyer.

After drafting the lease, Quichocho reported to Nam that they needed to go to Rota to obtain the signature of Atalig who was also an owner of the premises.

Nam bought the plane tickets for Quichocho and himself to go to Rota, Thompson said.

When they returned to Saipan, Quichocho presented to Nam the lease agreement for the first time, and directed Nam to sign the lease. The lease was written in English and not translated to Nam at that time, Thompson said.

On March 20, 2009, Quichocho and Atalig mailed a notice of default and violations to Nam regarding the ground lease.
