Demapan declined to comment when asked if the Fitial administration is conducting a parallel investigation regarding the case, which involves DYS jail guard Tyron Farley Reyes Fitial, 24.
A staffer from the federal court said Fitial’s detention hearing and arraignment had been moved to Wednesday.
In the custody of the U.S. Marshals Service since his arrest on Friday, Fitial is expected to appear before visiting Senior Judge Consuelo Bland Marshall of the Central District of California.
Fitial was charged with one count of deprivation of rights under color of law by federal agents and local police.
Assistant U.S. Attorney James J. Benedetto, the prosecutor, said there are three minor children involved in the case.
Local lawyer Bruce Mailman has been appointed as one of the victims’ guardian ad litem.
